1. Acceptance of Subscription Terms and Conditions

These terms and conditions (“Agreement”) govern your use of the Torched Bar & Grill Preferred Guest/Preferred Premier Guest Subscription Program (“Subscription” or “Membership”). By enrolling at https://torchedbarandgrill.com/preferred-guest, you agree to this Agreement, which includes the Terms of Use and Privacy Policy. If you disagree with any part of this Agreement, do not subscribe. If you disagree with any updates, cancel your Subscription. In case of a conflict, this Agreement prevails over the Torched Bar & Grill Program Terms.

IMPORTANT: This Agreement includes mandatory arbitration and a class action waiver. See Section 9.

You must be 18 or older to subscribe.

2. Updates to this Agreement

Torched Bar & Grill may update, change, or modify this Agreement at any time. Changes are effective when posted on https://torchedbarandgrill.com/preferred-guest. You waive any right to receive specific notice of such updates.

3. Electronic Form

By using the Subscription, you consent to receive this Agreement and related communications electronically.

4. Your Subscription

By subscribing, you agree to provide and maintain accurate information. Torched Bar & Grill may suspend or terminate your Subscription for violations. Subscription is limited to one per person and cannot be shared. You must be a member of Torched Bar & Grill to subscribe.

5. Subscription Benefits

Monthly subscriptions are available for $15 per month or $30 per month depending on the tier chosen, and the benefits for each tier are as follows:

Not valid with any other offer. Limit of one subscription offer per person, per visit may be redeemed.

6. Charges to Your Payment Method

By enrolling, you authorize Torched Bar & Grill to charge your payment method for the subscription fees until cancellation. You remain responsible for any uncollected amounts. If payment fails, access may be suspended until a valid payment method is provided. We use a third party company to process the subscription payments called Deals Around Town.

7. Recurring Billing and Cancellation

Subscription fees are charged on a monthly recurring basis. To cancel, please email [email protected] and include your name as it appears on the account and the phone number associated with the account. Cancellation requests must be made at least 24 hours before the next billing cycle. No prorated refunds are provided for unused portions.

8. Current Information Required

Notify Torched Bar & Grill if your payment method is canceled or if there is a potential security breach.

9. Dispute Resolution; Arbitration Agreement; Class Action Waiver

This section limits certain rights, including the right to court actions and class actions. All disputes will be resolved by binding arbitration.

(a) Mandatory Notice of Dispute and Informal Dispute Resolution Process

Before initiating arbitration, provide a written Notice of Dispute to Torched Bar & Grill, and attempt to resolve the issue informally. Deals Around Town is the software and collections company and shall be held harmless in any dispute.

(b) Arbitration Agreement

If unresolved, disputes will be submitted to binding arbitration according to the AAA Rules.

For multiple similar claims, a bellwether process will be used for initial arbitration cases.

(d) Future Changes to Dispute Resolution Section

You may reject changes to this section by providing written notice within 30 days.

(e) No Class Actions

All disputes must be resolved individually without resort to any form of class action.

This Agreement governs your participation in the Torched Bar & Grill Preferred Guest Subscription Program.
